Introduction and acceptance
These Terms and Conditions (“Terms”) govern your use of whs-rcm.com (the “Website”), operated by WhiteAce Healthcare Solutions LLC (“WHS,” “we,” “us,” or “our”), a Wyoming limited liability company. WHS is the trading name of WhiteAce Healthcare Solutions LLC.
By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
If you use the Website on behalf of a practice or other organization, you confirm that you are authorized to accept these Terms on its behalf.
Using our website
The Website is for business use by healthcare providers, practice staff, and other professionals who are at least 18 years old. You may use it to learn about our services, contact us, book consultations, and subscribe to our newsletter.
You agree not to:
- Use the Website for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or another person’s information
- Attempt to gain unauthorized access to the Website, its servers, or any connected systems
- Upload viruses, malware, or any code designed to disrupt or damage the Website
- Scrape, copy, or harvest content or data from the Website by automated means
- Interfere with other visitors’ use of the Website
We may suspend or restrict access to the Website at any time if we believe these Terms have been violated.
No patient information through the website
Do not submit protected health information (PHI) or any patient details through the Website. This includes our contact forms, appointment booking, newsletter sign-up, and any email or text message you send in response to our outreach.
We receive PHI only after a client has signed a services agreement and a Business Associate Agreement with WHS, and only through secure channels agreed with that client. If PHI is sent to us through the Website, we will delete it and are not responsible for its transmission.
Website content and no guarantees
Content on the Website is general information about medical billing and our services. It is not legal, tax, financial, coding, or medical advice, and it does not create a client relationship.
Performance figures on the Website, such as clean claim rates, days in accounts receivable, or collection rates, describe targets we work toward. They are not guarantees. Actual results depend on factors outside our control, including payer policies, the quality of clinical documentation, patient coverage, contracted rates, and regulatory changes.
We work to keep the Website accurate and current, but we do not promise that all content is complete, error-free, or up to date.
Our services and client agreements
We provide billing services only under a signed written agreement. Booking a consultation or submitting a form does not create a contract for services.
- Signed agreements control. Each client’s services, fees, responsibilities, and term are set out in a signed Medical Billing Services Agreement. If that agreement conflicts with these Terms, the signed agreement controls.
- Business Associate Agreement first. Before we receive any PHI from a practice, including for a free billing audit, the practice and WHS must sign a Business Associate Agreement.
- Free billing audit. We may offer a free review of a practice’s recent claims. The audit is offered at our discretion, creates no obligation for either party, and its findings are estimates rather than guarantees.
- Pricing. Any pricing shown on the Website or discussed before signing is indicative. Final fees are those stated in the signed agreement.
Text messaging terms
You can stop our text messages at any time by replying STOP.
- Program. WHS sends text messages about consultations, appointment reminders, follow-ups, and information about our medical billing services to people who have provided their mobile number and agreed to receive them.
- Frequency. Message frequency varies.
- Cost. Message and data rates may apply, depending on your mobile plan.
- Opt out. Reply STOP to any message to unsubscribe. You will receive one message confirming your opt-out and no further messages unless you opt in again.
- Help. Reply HELP for assistance, or contact us at info@whs-rcm.com or +1 (307) 364-6089.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Consent. Agreeing to receive text messages is not a condition of any purchase.
- Privacy. We handle your mobile information as described in our Privacy Policy. We never share mobile numbers or text-message consent with third parties for marketing.
Intellectual property and third-party links
Our content. The Website and its content, including text, graphics, logos, and design, belong to WHS or its licensors and are protected by intellectual property laws. You may view and print pages for your own business use. You may not copy, modify, distribute, or republish the content without our written permission.
Third-party names. Names of software systems, payers, and other companies on the Website belong to their owners. Their mention does not imply endorsement or partnership.
Third-party links. The Website may link to sites we do not control, such as LinkedIn. We are not responsible for their content, terms, or privacy practices.
Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WHS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Website will be uninterrupted, secure, or free of errors, viruses, or other harmful components. Services provided to clients carry only the warranties stated in the client’s signed agreement.
Limitation of liability and indemnification
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WHS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
This limitation applies to use of the Website only. Liability for services provided to clients is governed by the client’s signed agreement.
Indemnification. You agree to indemnify and hold harmless WHS and its members, employees, and contractors from any claims, losses, or expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Website.
Governing law, disputes, and general terms
Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules.
Disputes. If a dispute arises about the Website, please contact us first so we can try to resolve it informally. Disputes about client services are resolved as set out in the client’s signed agreement.
Changes. We may update these Terms from time to time. Updated Terms take effect when posted on this page with a new effective date. Continuing to use the Website after that means you accept the updated Terms.
General. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and WHS about the Website.
